3. Offer and Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to order.

By clicking the "Buy Now" button, the customer submits a binding offer to purchase the goods contained in the shopping cart.

The contract is only concluded when we accept the order by sending an order confirmation via e-mail or by dispatching the goods.

4. Prices and Shipping Costs

All prices are in Euros and include statutory VAT, unless otherwise stated.

In addition to the stated prices, shipping costs may apply. These will be clearly communicated to the customer during the ordering process.

5. Delivery and Shipping

Delivery will be made to the delivery address specified by the customer.

Unless otherwise agreed, delivery will take place within 3–10 working days after receipt of payment.

Should an item be temporarily unavailable, the customer will be informed immediately.

6. Payment Terms

The following payment methods are accepted:

- Credit card
- PayPal
- Bank transfer

Payment will be charged immediately upon completion of the order.

7. Retention of Title

The goods remain our property until full payment has been received.

8. Right of Withdrawal

Consumers are entitled to the statutory right of withdrawal of 14 days in accordance with the Distance and Off-Premises Contracts Act (FAGG).

The withdrawal period is 14 days from the day on which the customer, or a third party named by them, took possession of the goods.

To exercise the right of withdrawal, the customer must inform us of their decision by means of a clear declaration (e.g., e-mail or letter).

9. Consequences of Withdrawal

If this contract is withdrawn, we will refund all payments, including shipping costs, without delay and within 14 days of receipt of the notification of withdrawal.

For this refund, we will use the same payment method used for the original transaction.

The customer must return the goods to us immediately, no later than 14 days.

The direct costs of the return shipment are to be borne by the customer.

10. Exclusion of the Right of Withdrawal

No right of withdrawal exists for:

- sealed goods which are not suitable for return for health or hygiene reasons if the seal has been removed,
- custom-made products,
- audio or video recordings or software if the seal was removed after delivery.

For used records, the right of withdrawal only applies provided there is no deterioration due to improper use.

11. Condition of Used Records / Grading

The condition of our records is generally assessed according to the internationally established Goldmine Grading System. In doing so, we use the following grading levels in particular:

  • NM (Near Mint)
  • VG+ (Very Good Plus)
  • VG (Very Good)
  • G+ (Good Plus)
  • G (Good)
  • Fair

The grading of the offered records is primarily based on visual condition. If a record has been played or tested, this will be explicitly noted in the item description.

Since the interpretation of condition ratings such as “NM” (Near Mint) or “VG+” (Very Good Plus) often varies in the international record trade – especially on platforms like Discogs – we also use designations such as “VG++”, “EX”, or “strong VG+”. These additional specifications are intended to provide the most precise assessment possible of the actual condition.

These are typically records that are in very good visual condition but may show minimal hairlines, light scuffs, or fine signs of use, which are usually only visible under bright light.

The same applies to covers and sleeves: well-preserved covers with nice corners may still show slight creases, minimal storage wear, or signs of use without significantly impairing the overall very good impression.

Buyers are therefore expressly requested to consider both the stated grading and the respective item description to form the most accurate picture of the record's actual condition.

For most of the records offered, existing price labels have been removed. If price stickers are still present or if their removal has caused slight damage, this will be explicitly stated in the respective item description.

Versions & Pressings

We always strive to identify the correct pressing and version of a record. To the best of our knowledge and belief, approximately 98% of the vinyl records offered are correctly identified.

In particular, for collector records (e.g., by bands such as The Beatles, The Rolling Stones, or Led Zeppelin), extensive research into matrix numbers, label variants, and pressing details is sometimes conducted.

If the buyer is looking for a specific pressing variant, this must be communicated explicitly before placing the order. Without prior inquiry, no guarantee can be given that a specific pressing variant will exactly meet the buyer's expectations.

12. Warranty

Statutory warranty rights according to Austrian law apply.

For used goods, the warranty period may be shortened to one year, provided this is legally permissible.

13. Liability

We are liable without limitation for damages resulting from injury to life, body, or health.

For other damages, we are only liable in cases of intent or gross negligence.

14. Data Protection

Information on the processing of personal data can be found in our privacy policy.

15. Applicable Law

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For consumers, this choice of law only applies insofar as it does not limit any mandatory legal provisions of the state in which the consumer has their habitual residence.

16. Dispute Resolution

The EU Commission provides a platform for online dispute resolution:

https://ec.europa.eu/consumers/odr

We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

17. Final Provisions

Should individual provisions of these GTC be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
